The Variety Band ("we," "us," or "our") owns and operates varietyband.us and other sites linking to these Terms of Use (the "Site" or "Sites"). Through the Sites, The Variety Band provides various offerings, information, and resources related to the products and services available on our Sites (each a "Service" and collectively, the "Services").

The Variety Band may change, suspend, modify, or discontinue all or any part of the Sites in its sole discretion with or without notice. We reserve the right to block or deny access to any of the Sites to anyone at any time for any reason.

General Terms

These Terms of Use are an agreement between The Variety Band and the individuals that use the Sites (or the parent/legal guardian of any such individuals under the age of 18) ("users," "you," or "your"). By using or accessing the Sites, you represent and warrant that you are of legal age to accept these Terms of Use and form a binding contract with The Variety Band.

IF YOU ARE UNDER THE AGE OF 18 (A MINOR), YOUR PARENT OR LEGAL GUARDIAN MUST READ AND CONSENT TO THE TERMS OF USE BEFORE YOU USE THE SITES. BY PERMITTING A MINOR TO USE THE SITES, THE MINOR'S PARENT OR GUARDIAN BECOMES SUBJECT TO THE TERMS OF USE AND AGREES TO BE RESPONSIBLE FOR THE MINOR'S ACTIVITIES ON THE SITES.

PLEASE READ THE TERMS OF USE CAREFULLY. BY ACCESSING ANY PAGES ON THE SITES OR USING ANY SERVICES, YOU EXPRESSLY AGREE THAT YOU, OR YOUR PARENT OR LEGAL GUARDIAN FOR USERS UNDER THE AGE OF 18, HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS OF USE. DO NOT USE THE SITES IF YOU DO NOT AGREE.

Changes to the Terms of Use

The Variety Band reserves the right to update or modify the Terms of Use at any time, with or without prior notice. Any such changes will become effective upon the earlier of (i) the first time you use the Sites or Services with actual notice of the change(s), or (ii) 30 days after the change(s) are publicly posted on the Sites. We encourage you to review the Terms of Use frequently to stay informed of any changes.

Account Access and Security

You may be required to register and create an account to access some content and functionality on the Sites. You are responsible for maintaining the confidentiality of your account and password. You agree to notify The Variety Band immediately if you become aware of any unauthorized access to or use of your account. Any information you provide to The Variety Band must be correct, current, and complete.

User Content

The Sites may contain Services that allow you and others to post, submit, publish, display, or otherwise transmit various information and materials ("User Content"). You retain ownership rights in and to your User Content. By posting User Content to the Sites, you grant The Variety Band an unrestricted, non-exclusive, perpetual, royalty-free, worldwide license to use, edit, copy, reproduce, display, publish, distribute, and perform such User Content and derivatives thereof, in whole or in part, in any form or media now known or hereafter developed.

You represent and warrant that: (a) you own or control all rights in and to such User Content, (b) you have the right to grant The Variety Band the license described above, and (c) the User Content complies with these Terms of Use.

Content Standards

You agree that you will not post any User Content that infringes on intellectual property rights, fails to comply with applicable laws, or contains expressions of hate or abuse. User Content must not:

  • Contain defamatory, obscene, abusive, harassing, violent, hateful, or sexually explicit material;
  • Promote violence or discrimination based on race, ethnicity, sex, religion, nationality, disability, sexual orientation, gender identity, or age;
  • Violate any person's legal rights, including intellectual property, moral rights, or rights of publicity and privacy;
  • Impersonate any person or entity or misrepresent your identity;
  • Contain any material that is unlawful or could result in civil or criminal liability;
  • Involve commercial activities such as contests, sweepstakes, or advertising not conducted by The Variety Band;
  • Conflict with these Terms of Use or any applicable law or policy.

Custom Service Terms

Personal Lyrics & Custom Song Services

When you purchase a custom song or personal lyrics through The Variety Band ("Custom Song Service"), the following terms apply in addition to the general Terms of Use above.

Ownership

Upon full payment and delivery, you (the client) own the finished song and its lyrics. The Variety Band transfers all creative rights in the delivered composition to you.

Distribution to Streaming Platforms

As part of the service you have purchased, The Variety Band will distribute your song to major streaming platforms — including Spotify, Apple Music, Amazon Music, YouTube Music, Tidal, and Deezer — so that you and the general public may listen to it through those services. This distribution is included in your purchase and cannot be opted out of.

No Sharing or Resale

While you own your song, you may not share, sell, license, sublicense, transfer, or otherwise distribute the song, its lyrics, or any recording thereof to any third party outside of the authorized streaming platforms listed above. The song is created exclusively for your personal use and enjoyment through those streaming channels.

No Commercial Exploitation

You may not use the song for commercial advertising, sync licensing, film or TV placement, or any revenue-generating purpose without prior written consent from The Variety Band.

One Song Per Purchase

Each purchase entitles you to one (1) custom song. The delivered song is final; revisions are not included unless separately agreed upon in writing.

Delivery

Songs are delivered digitally via the My Song retrieval page using your order ID from your GoDaddy payment confirmation email. The Variety Band is not responsible for delays caused by incorrect order information provided by the client.

Governing Law and Jurisdiction

You agree that all matters relating to the Sites and these Terms of Use and any dispute or claim arising therefrom or related thereto shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule.
